DISABILITY BENEFIT PROVIDED BY THE FUND

ELIGIBILITY

You will become eligible for Disability Benefits if:

1. You were employed continuously in covered employment in the electrical construction industry by a participating employer for 36 months or more immediately preceding disability, and you have worked:

a. 250 hours during the 3 months immediately preceding disability;
b. 500 hours during the 6 months immediately preceding disability;
c. 750 hours during the 9 months immediately preceding disability; or
d. 1 ,000 hours during the 12 months immediately preceding disability.

2. You began your work in the electrical construction industry less than 36 months prior to your disability and have been continuously employed by a participating employer, and have worked the required hours in 1 above.

3. In the event you do not qualify for benefits under either 1 or 2 above, you will be entitled to one month's benefit for each month you have worked in covered employment up to a maximum of 24 months, provided you are employed in covered employment on the date of your disability, and meet the hours worked requirements as stipulated in 1 above.

4. For the purpose of eligibility, for this Disability Benefit only, you must be:

a. registered for work with the Union; b. available for work; and
c. eligible for benefits under the Kern County Electrical Workers Health and Welfare Trust.

AMOUNT OF MONTHLY INCOME

The Long Term Disability Benefit consists of a monthly income for up to two years. Payments will commence on the first day following your completion of the elimination period of 30 days. Amount of Benefits: $400 per month, however, if benefit plus other income exceed 66-2/3% of salary the plan benefits will be reduced by the excess over 66-2/3%. The maximum number of monthly benefits is 24. The benefits stipulated above will be reduced by any wages, salary or other renumeration you may receive from Contributing Employers, or from any other employer, while you are eligible for income payments from the plan. Also counted as reductions are any disability benefits payable under any law or under any Group Plan. Examples would be disability benefits payable under Social Security and Workmen's Compensation laws, including any dependents' benefits, or under Group insurance or Retirement plans. .
