LOCAL 428 DISPATCH PROCEDURE

1. Applicants for employment are eligible to sign the out-of-work list when terminated from a signatory contractor in this jurisdiction. Applicants may sign the out-of-work list between the hours of 8:00 AM -12:00 PM and 1:00 PM - 5:00 PM, Monday through Friday. Applicants signed on the out-of-work list by 8:30 AM will be eligible for dispatch that same day. Applicants signed on the out-of-work list after 8:30 AM will be eligible for dispatch the following day.

2. Applicants for employment will be placed in the highest priority group for which they qualify. When two or more applicants for employment sign the out-of-work list on the same day, a drawing will be held to determine their relative position on the referral book. Applicants, who sign the out- of-work list after 8:30 AM, and before 5:00 PM, will be in the first draw. Those applicants who sign the out of work list between 8:00 AM and 8:30 AM will be in the second draw.

3. Dispatch hours are from 8:30 AM until complete, Monday through Friday. There will be no dispatch on holidays, except in cases of emergency.

4. Applicants for employment must sign the referral book at the Local Union office at 911 20th Street, Bakersfield, CA. by 8:30 AM for that day's dispatch. Only those applicants available at the Union office will be offered employment according to their respective place on the referral book.

5. Applicants for employment will be offered all jobs needing to be filled when they are present and their position on the referral book is reached.

6. Re-sign of the book will be established as needed, as determined by the Business Manager.

7. Applicants may list their certifiable special skills, such as Oilfield, Welding, Cable Splicing, etc.

8. Applicants will not lose their place on the referral book if an employer refuses to accept them as permitted in Section 4.03 of the mside and Oilfield Agreements.

9. If an employee works 15 consecutive calendar days or less and is terminated through no fault of their own, they shall be returned to their appropriate place on the referral book, providing the applicant brings in their termination slip and signs the out-of-work list within eight (8) hours working time, as required by Article XTV, Section 11 of Local 428 bylaws.

10. Applicants accepting referrals and not reporting for work as scheduled shall be referred to the Local Union Executive Board.

11. Applicants found violating the Dispatch Procedure will be referred to the Local Union Executive Board.
